The Massachusetts Fiscal Alliance issued a scathing rebuke of Governor Maura Healey, Senate President Karen Spilka, and House Speaker Ron Mariano as large numbers of criminal defendants, including some charged with serious violent offenses, are being released due to the Commonwealth’s failure to adequately deal with the indigent defendants issue.
“This situation is spiraling into a full-blown constitutional crisis and Governor Healey is nowhere to be found. Hundreds of accused individuals are being released, not because they are innocent, but because the Commonwealth has failed to uphold one of the most basic functions of government: providing legal counsel to those who cannot afford it. The Governor’s decision to jet off on vacation to who knows where and for who knows how long, without addressing this slow-motion disaster, shows a shocking lack of leadership and irresponsible decision making” said Paul Diego Craney, Executive Director for the Massachusetts Fiscal Alliance.
The Healey administration and legislative leaders had ample warning and time to prevent this crisis. Instead, the FY2026 budget they rushed through behind closed doors, without public review or real debate, prioritized earmarks and ideological pet projects over basic governance. That includes a $5 million appropriation for legal services for illegal immigrants while failing to negotiate a resolution with the state’s public defenders.
“Speaker Mariano and Senate President Spilka had no problem quietly stuffing the budget with millions for special interests, and pet projects for their districts and the districts of the lawmakers who help elect them. These legislative leaders have created a completely broken legislative system at the State House and now due to their lack of leadership, our judicial system is temporarily broken and making national news. This situation was entirely avoidable, but Beacon Hill chose secrecy, shortcuts, and showmanship over responsibility. It’s a disgrace and a national embarrassment,” added Craney.
Under a protocol ordered by the state’s highest court, defendants who go a week without legal representation must be released. One of the first released was charged with strangling his pregnant girlfriend. More releases and even dropped charges are expected in the coming days if the situation remains unresolved.
“Imagine what happens if one of these criminally charged individuals let loose by the courts commits another serious crime. This is anarchy. It’s entirely preventable, if only our state leaders took the matter seriously. Instead, our Governor is on vacation somewhere. She could be coming back tomorrow, or next week. We don’t know because she refuses to say. Could you imagine this kind of behavior from a CEO during a crisis at a private company? The people of Massachusetts deserve to have their safety prioritized over yet another stint of an MIA governor,” noted Craney.
MassFiscal is calling on the Governor to immediately return to the state, and for legislative leaders to reconvene the legislature and take action to address the issue without delay.
“If Governor Healey truly cares about public safety and the rule of law, she’ll stop hiding, come home, and fix this. Until then, every preventable release is a damning indictment of Beacon Hill’s broken culture,” closed Craney.
